Creditor Harassment
When you are in debt the tactics that some creditors
use to get you to pay are in direct violation of the Fair
Debt Collection Practice Act. Some times you will be threatened with:
- Being sued: You can only be sued if the original
creditor authorizes it. A third party collection agency cannot
initiate legal action against you. Some creditors will always give permission
to sue but it usually is not the case
- Being sent to jail: You cannot be threatened with
going to jail by a creditor, it is illegal under the fair debt
collection act. When threatened like this, simply take notes on who
is threatening you and look into taking action against them.
- Being audited by the IRS: Being audited by the IRS
for personal debt is simply not possible using
fair debt collections, not to mention illegal under the Fair
Debt Collection Practice Act. Once again, find out who is threatening.
