Frequently Asked Questions

Q: Can a collector call me late at night?
A: Collectors, under the Fair Credit Collection Practices Act, cannot call you between 8:00 am and 9:00 pm.

Q: Can a collector call me at work?
A: A collector can call you at work until you ask them to stop, at which point they must, as stated in the Fair Credit Collection Practices Act.

Q: Can a collector get my employer to garnish my wages to pay my debt?
A: This is usually a bluff since your wages cannot be garnished without due process and with a judge's signature. This means that the collector must first sue you, bring you to court, and get the judge to issue an official document to your employer to garnish your wages.

Q: When do I know that I need debt counseling?
A: Whenever you start to feel overwhelmed by your debt or you do not know what to do with your debt it is probably time to seek out a debt counseling service.
